TERMS AND CONDITIONS

PARTIES

Contract

This service contract (hereinafter referred to as the "Agreement") is entered into on August 10th, 2024, by and between the Service Recipient, (hereinafter referred to as the "Consumer", "Customer", "User") and UniRents (Service Provider) (hereinafter referred to as the "Renter", "Owner", "Us") (collectively referred to as the "Parties").

The customer agrees to pay the sum specified at the checkout page for the product selected. After payment, the owner will hand over the selected products to the customer.

This Agreement shall become effective on the date of the conclusion of the order on unirents.de and the payment of the amount, and will expire on the last semester day, either after 200 days when the rental duration is for 1 semester or 330 days when the rental duration is for 2 semesters.

The owner reserves the right to deliver products that differ from the image presented. UniRents ensures that the product will have the same quality, features, and attributes (capacity, color, but not exact shape) as selected.

If the customer decides to return the product, the fee paid will not be refunded. The contract will terminate within the contractual period as specified.

UniRents is authorized to charge a fee equal to the contractually agreed fee for the period of withholding if the user fails to return the rented items to us after the rental period has ended.

COSTS AND PAYMENT

The rental price includes applicable taxes (e.g., VAT where applicable), but shipping fees are not included in the rental price. The customer will see a detailed breakdown of the total price at the checkout page.

The customer agrees to make a one-time payment for the rental as specified during checkout.

The available payment methods include bank transfer, PayPal, and credit card.

RENTAL CONDITIONS

The contract specifies a one-time payment for the rental period. There is no deposit required for the rental. Instead, the customer agrees that if any rented items are damaged or not returned by the agreed-upon return date, they will be charged a penalty fee. This fee will be 130% of the rental price paid for the item(s) in question (excluding shipping fees and additional taxes).

After successful payment, the goods will be delivered to the customer's selected address and selected time and day slot, subject to availability and delivery conditions. Delivery times may vary in case of unforeseen delays.

The customer will have access to the rented items during the rental period. The customer agrees to handle the items with care and notify UniRents immediately in the event of damage or defects.

DAMAGE, NON-RETURN POLICY, AND RETURN REMINDERS

Effective immediately, no deposit will be required for any rental. However, the customer agrees that if any rented items are damaged or not returned by the agreed-upon return date, the customer will be charged a penalty fee of 130% of the rental price for the item(s) in question (excluding shipping fees and additional taxes).

Return Reminders: To ensure the timely return of products, the customer will receive multiple reminders:

First Reminder: The customer will be reminded of the return deadline approximately 45 days before the end of the semester.

Second Reminder: A follow-up reminder will be sent around 21 days before the end of the semester.

Final Reminder: On the last day of the rental period, the customer will receive a final reminder via messages and calls to arrange for the return of the products. If the customer fails to respond or schedule the return, they will be held liable for the missed return.

Post-return Reminder and Fine Collection: If the products are not returned by the agreed date, the customer will be charged the penalty fee as described above. After this, the customer will be contacted as often as necessary to ensure payment of the fine. Failure to pay the penalty fee may result in further actions to collect the owed amount.

LIABILITY AND INSURANCE

The customer is responsible for the protection of rented items and must return them in the same condition as they were received. UniRents does not provide insurance for rented items, and the customer agrees to pay for any damages or loss of items as specified in the DAMAGE, NON-RETURN POLICY.

UniRents is not liable for personal or property harm caused by misuse of rented items. UniRents is only liable for the culpable violation of fundamental contractual obligations, after it has been made known to them and they have not addressed it within an appropriate period.

CANCELLATION POLICY

The customer may cancel the contract before the delivery of rented items. In this case, UniRents will refund the paid rental amount, excluding any transaction fees. However, once the product has been delivered, the contract cannot be canceled.

In the event that the customer terminates the contract after the delivery of products, they are required to immediately return the rented items to UniRents.

DISPUTE RESOLUTION

Any disagreement or difference arising out of or in connection with this Agreement shall be referred to arbitration/mediation/negotiation in accordance with, and subject to Germany's civil law.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws on service contracts (§611 etc.) in Germany.

AMENDMENTS

Any amendments to this Agreement must be made in writing and signed by both Parties. Any amendments made by the Parties shall be included in this Agreement and presented to the Parties in writing.
